This is a distinct consumer-service underwriting problem, not generic debt collection. The acquirer needs to understand what you promise, when the customer pays, what work is completed and which laws apply. A payment account cannot make a prohibited advance-fee model lawful.

Short answer

Can credit repair businesses obtain merchant accounts?

Some cases may be supportable after review of the actual service, legal requirements, billing model and provider appetite. Approval is not universal.

  • Can I collect prohibited advance fees using ACH instead: Changing the payment rail does not remove legal restrictions. Have qualified counsel assess the payment timing before processing.
  • Is this the same as a debt-collection account: No. Credit repair and debt collection are distinct activities. Describe the real service and relevant permissions.
  • What information belongs in the first enquiry: Company country, website, service and billing description, sales channels, monthly volume and previous refusal. Do not send consumer credit reports.

Credit repair is not the same activity as debt collection

Describe the actual service: disputing inaccurate report entries, providing education or another clearly defined service. Credit repair, debt settlement, lending and debt collection are different activities with different obligations. Do not select a lower-risk label or merchant category to hide what you sell.

Explain the customer acquisition channel, contract, service milestones and complaint process. Underwriters need to see whether the business can evidence performance and whether marketing promises match the work delivered. A vague description such as financial consulting is not enough.

Review advance-payment restrictions before selecting a rail

The FTC’s CROA summary explains restrictions on misleading claims and advance payment, alongside disclosure, contract and cancellation requirements. Where the Telemarketing Sales Rule applies, credit-improvement services face additional payment conditions. Have qualified US counsel assess your actual sales channel and billing arrangement before an application.

Switching from cards to ACH, delaying capture or calling a charge a membership fee does not automatically solve a legal restriction. Xavion assesses payment placement, not legal compliance certification. If the billing model cannot be supported, the next step is correction rather than another processor.

The underwriting file should follow the customer journey

Prepare sample advertisements, landing pages, contracts, disclosures, cancellation wording and a clear description of when fees become due. Show how each service milestone is recorded and how customers obtain support. Include relevant registrations or legal assessments, ownership records and available payment statements.

Marketing affiliates and call centres matter because claims made before signup can generate disputes later. Explain how you approve scripts, monitor promotions and deal with complaints. Provide anonymised examples initially; do not send consumer credit reports or identity documents in the first enquiry.

Recurring billing and ACH require separate permissions

A recurring-payment plan needs transparent terms and a lawful basis for the payment timing. The processor will assess customer consent, cancellation and evidence of the underlying service. Merchant-account approval does not excuse non-compliant fees or guarantee permission for every recurring charge.

ACH collection is a separate facility, with its own authorisation and return risks. A bank account that receives ACH transfers is not permission to debit customer accounts. Compare the supported payment method against both the legal model and provider requirements.

Reserves, disputes and previous terminations

Supply actual complaint, refund and chargeback history where it exists. Explain the root cause of disputes and the corrective measures already operating. Do not promise the underwriter that changing the descriptor alone will fix a misleading offer or unfinished service.

Ask for written pricing, reserve calculations, settlement availability and post-termination terms. No universal dispute ratio guarantees acceptance. Disclose past closures honestly and keep any old-provider refund or reserve process separate from the replacement application.

Get a case-specific payment review

Send your company and operating countries, website, service description, billing timing, marketing channels and monthly processing need. We assess whether a specialist acquiring route is realistic and identify the evidence gaps before an introduction. The initial review is free; paid work is agreed separately.

We do not promise universal approval, repair credit reports or give legal advice. A suitable processor must explicitly accept the true activity and compliant billing model. If those conditions are unresolved, we tell you rather than offer a workaround.
