Need a safeguarding account for a payment institution or electronic money business? Xavion offers a free consultation to assess your firm, identify the account function you need and point you toward a suitable institution. We help prepare the placement file and coordinate onboarding questions where the case is supportable. We are an intermediary, not a bank or regulator. Any paid engagement is agreed separately.

This service is for firms assessing customer-funds arrangements, not a personal account or an ordinary account for payroll. Account opening alone does not establish regulatory compliance, and a provider’s willingness to review your firm is not approval. Tell us your authorisation status, jurisdiction and expected flows before approaching institutions.

Short answer

Is the safeguarding account consultation free?

Yes. The initial consultation and case review are free and without obligation. We assess the firm, identify missing evidence and point you toward a suitable institution where we can help. Any paid placement engagement is agreed separately.

  • Can a firm applying for authorisation enquire: Yes. State that you are a prospective firm and explain the application stage. Institutions differ on whether they review prospective firms.
  • Can I use an ordinary business account for safeguarding: Do not assume so. The account designation, documentation, contractual treatment and applicable safeguarding requirements need to be assessed. An operating account for the firm’s own expenses is a different function.
  • Is a crypto company automatically eligible: No. Crypto activity, payment services, e-money issuance and custody must be distinguished. Your actual activity, permissions, jurisdiction and funds flow determine which arrangement can be considered.

Who this safeguarding account service is for

We review enquiries from payment institutions, electronic money institutions and firms planning an application for those permissions. An authorised firm replacing an existing arrangement has different constraints from a prospective firm seeking evidence for an application. State which stage you are at and whether customer funds are already being received.

For UK firms, the FCA explains that safeguarding is mandatory for authorised payment institutions, authorised e-money institutions and small e-money institutions under the applicable rules. Do not assume every small payment institution has identical obligations: the FCA guidance addresses those separately. Your compliance adviser should establish which requirements apply to the actual activity.

For European firms, give us the home regulator, permissions and countries of operation. UK rules are not a substitute for your local framework. A crypto business holding customer assets should not assume its crypto authorisation makes it a payment institution or that a safeguarding account authorises additional activity. We first distinguish payment services, e-money, custody and the company’s own treasury.

Safeguarding account versus operating account and client-money account

An operating account pays the firm’s own suppliers, staff and expenses. A safeguarding arrangement protects relevant customer funds under the regime that applies to the firm. Moving customer balances into an ordinary operating account does not make it suitable merely because its product name includes business banking.

Client-money and segregated-account searches can refer to different arrangements, including professional firms or investment businesses. Separation of funds is important, but the label alone does not establish that the account meets payment or e-money safeguarding rules. Confirm the legal account holder, designation, permitted flows, applicable regime and contractual treatment with the institution and your compliance adviser.

The FCA describes segregation and insurance or comparable-guarantee methods under the relevant regulations. This page concerns assistance with an account-based arrangement, not advice that an account is the only lawful method. Do not treat safeguarding as equivalent to personal bank-deposit protection or a promise of instant access if a firm fails.

What to send for your free consultation

Start with the firm’s incorporation country, regulator, authorisation or application status, actual services and ownership structure. Describe who pays in, whose funds the balance represents, when funds become relevant to safeguarding, who receives payouts and which countries and currencies are involved. Include projected average and peak balances, monthly transfer values and counts, and any existing institution’s notice or known refusal reason.

Explain your reconciliation process, safeguarding policy, compliance responsibilities and proposed account architecture. If you are migrating an existing arrangement, flag contractual deadlines and operational dependencies. For an initial enquiry, a clear description is enough: do not send passwords, private wallet keys or identity-document scans through chat. We can explain which documents belong in the formal onboarding file later.

Our consultation is free and without obligation. We assess the fit, identify missing evidence and point you toward a suitable institution where there is a supportable route. We do not promise a particular bank, a fixed opening date or acceptance before the provider completes its checks.

Acknowledgement letters and the account documentation

For UK firms subject to the relevant CASS requirements, FCA Handbook CASS 15.7 explains the purpose and content of safeguarding account acknowledgement letters. These put the third party on notice of customers’ interests, distinguish relevant funds from other funds and address the institution’s rights against the balance. The Handbook sets out requirements and exceptions; your adviser should apply the current provisions to your arrangement.

Ask early whether the proposed bank can accommodate the required designation and acknowledgement documentation. A standard account confirmation or marketing statement is not automatically the required countersigned letter. Review the legal entity holding the account, contractual terms and permitted use before treating the arrangement as ready.

Xavion can help coordinate account-opening questions and the evidence pack with the institution. The firm remains responsible for its regulatory obligations, reconciliations and ongoing controls. We do not issue regulatory approval or certify that opening an account alone makes the business compliant.

Replacing a safeguarding provider without losing the operational picture

If the current institution has declined, changed its appetite or given notice, identify the affected account and functions first. An operating-account closure and the loss of a customer-funds arrangement require different plans. A replacement needs to support the actual balances, counterparties, currencies and flow design, not just issue new account details.

Discuss the transition with your compliance adviser and existing provider before moving relevant funds. Keep reconciliations, customer entitlements, account records and required documentation aligned throughout the change. Confirm how inbound collections, outbound payouts and any linked settlement facilities will work under the new contract. Do not assume opening a new account releases funds restricted at the old institution.

We help assess an alternative institution and coordinate application follow-ups. Timelines depend on the firm, permissions, evidence and institution; there is no universal opening deadline or promise of uninterrupted service.

Ask Xavion to assess your safeguarding account route

Write to us now for a free consultation. Tell us whether you are authorised, applying for permissions or replacing an existing account, and give us the firm’s jurisdiction and funds-flow summary. We will review the business and point you toward a suitable institution where we can support the case.

If further placement work is appropriate, we agree its scope and terms separately before paid work starts. This page does not promise safeguarding-account acceptance, licence approval or the lifting of existing restrictions. Suitability and onboarding remain subject to the institution’s checks and the requirements of your applicable regime.
